Mr Fernando,
Following on from our telephone conversation this evening I would like to confirm the following:
Having liaised with trading standards and the gaming board, we are satisfied that they have no issues with your practices.
I have spoken with Town Centre Management for Chelmsford who confirm that they work with you to pre-identify certain dates when you can trade within the town.
Provided your agents are in possession of a peddlers certificate (one each), then they are permitted to sell your products and gaming cards.
I have also confirmed that provided your agents make no references to the term "charity" then they are acting within the parameters of what is permitted by the peddlers certificate.
As stated, If we come across a situation or having circumstances brought to our notice whereby an agent has sold an item on the basis that it is for charity by either using direct words or implied words, then we will investigate the matter by gathering evidence and bring this to your earliest attention. From our discussion I am aware that if this were to happen we would have your support.
I will speak with my staff as discussed and ensure understanding and a consistent approach.
I trust you will continue to work with Michael Wray in identifying suitable trading dates.
I would like to remain a contact point for this issue and ask that any issues are brought to my attention. I will then delegate any issues as appropriate.
