I have been working selling helium balloons in glasgow and other towns in scotland but keep being told by the police that pedlars in scotland are only permitted to work door to door. I have researched this on the internet and can find nothing to back this up. I have emailed strathclyde police licensing department and they have said, Your pedlars certificate would not cover you to operate in the city centre unless selling door-to-door, and that You run the risk of being charged with Section 7 of the Civic Government (Scotland) Act 1982 if you continue to trade with your pedlars certificate alone.
Any help on this matter would be much appreciated.

You are correct... there is nothing in any legislation to back up the notion that a pedlar is a door-to-door seller. In fact door-to-door selling is unregulated for goods with a value less than £35.00. Please send pedlars.info the Strathclyde correspondence so we may respond to them about their wrongful interpretation of law.

Again using our friend legislation.gov.uk just entering 1982 as the year and the word Civic is enough to bring up the wonderful piece of Scottish legislation. It takes a bit of deciphering but you eventually get to the part 39 about Street Traders licenses and subsection 3 states 'A street traders license shall not be required for:' and part (d) 'any activity in respect of which a certificate under the M2Pedlars Act 1871 has been granted;'
So basically saying that as this law exempts anyone trading as a pedlar with a valid pedlars certificate then this law (which is all about granting the local authorities more power to 'license things') would not be appropriate in trying to prosecute a pedlar and any offences named under this law (section 7 is the section about offences under this law) would not apply.
