  • As a director of a company that neighbours Share a Little Love, I have heard Mr Fernando on countless phone calls dealing with the unlawful harassement of his colleagues by the police and some town centre managers.

    Mr Fernando runs a law abiding firm that trades on the streets of the United Kingdom and as such does nothing wrong, immoral or illegal.

    I have heard him contact the more informed town centre managers on many occasions as a courtesy to arrange when its convenient for his colleage's to be in Town, even though this isnt legally necessary.

    I think that there needs to be urgent action to educate the police officers and town centre managers so that the pedlars can carry on with their lawful business without being bullied or harrassed.

    Ignorance by town centre managers is the biggest single problem for pedlary and that is why pedlars seek government guidance so that existing legislation is applied consistently by all local authorities. BERR's own Better Regulation Office have championed this in the Regulatory Enforcement and Sanctions Act 2008 and provides an alternative to criminalising pedlars through private bills.
    Town centre managers enticed by afternoon canapes & wine parties attend meetings by Parliamentary Agents Sharpe Pritchard & powerful lobbists NABMA/LGA who seek repeal of pedlar legislation by sleight-of-hand meddling in LG(MP)Act 1982.
    The agents gravy train of around £200,000 per bill (7 Acts + 6 Bills in the current session = £2.6 million to date) probably covers the cost of such extravagant propaganda parties but what is disproportionately absent is invitation to pedlars who are directly affected.
    The very first ever consultation with pedlars will be summarised in a Durham University report to BERR in mid-November to inform government policy.
    MPs will resume the Second Reading debate on Wednesday 29th October in respect of six Private Bills which each look to outlaw lawful pedlars. MPs opposed to the Bills are calling on the promoters to await the findings of the Durham University research project and are emphasizing that the Bills should be directed solely against the activities of rogue street traders where the problem is lack of enforcement. A blanket law against all pedlars is an attack on free enterprise liberty and tradition.
