    FORMAL COMPLAINT – WITHOUT PREJUDICE

    I write on behalf of Frankie Fernando whose business name is Share a Little Love and whose agents operate under Primary Statute - the Pedlars Acts 1871 & 1881 and the Local Government (Miscellaneous Provisions) Act 1982.

    The complaint refers to an incident in Hastings that occurred today between a Local Authority Licensing officer Bob Brown in the company of a Community Police Officer and three of Mr Fernando’s agents who were acting as pedlars and were allegedly harassed and intimidated until they left the street.

    I draw your attention to a Pedlars Information Centre at http://www.pedlars.info where you will find the legislation under which pedlars may lawfully operate in Hastings and I invite you to refer me to any other legislation upon which your Community Police Officer may rely.

    In the absence of any other legislation you will please inform your officers to refrain from unwarranted harassment and intimidation of law-abiding pedlars in Hastings.

    Pedlars should expect every assistance, courtesy and politeness from your officers.

  • My name is Frankie Fernando I am the proprietor of Share a Little Love.
    I would like to warn all you pedlars if you work in Hastings town and you come across Bob Brown (council licensing) he will get right in your face and scream at you until he goes red in the face. Please don’t react because this is want he wants you to do . This is how he carried on with one of my agents last week. He was also saying that my agents were street collecting simply because he saw a compartment in the box for money – what a load of nonsense. It was Bob Brown who told me 8 months ago that we don’t fall under street collection.

    I am business that sells competition tickets with the winner receiving a great prize and from part of my profits I give forty holidays away a year.

    I will not be letting this matter rest as Mr Brown is a bully and needs to be stopped.

    I would also like to add that when he was screaming at a member of my staff. There was a police officer with him who just turned his back while this was going on.

    SO PLEASE BE CAREFUL OF THIS BULLY OF A MAN.

    Dear Mr Fernando,
    Further to our telephone conversation earlier this afternoon, I can confirm that so long as your staff operate in accordance with the letter our lawyers recently sent to your solicitors, there shouldn't be a problem. However, as I mentioned, if the Council recieves further complaints from members of the public we will be duty bound to investigate.
    Please feel free to email the Licensing Manager giving him notice of when your staff will be operating in Hastings. From what you said, if any such dates clash with days when authorised street collections are scheduled you may well decide not to visit the town on those days.

    Mr Fernando,

    I have discussed the matter at length with the officer involved and it appears that there is a disagreement of the legislation under the Pedlars Act 1871.

    The Officer spoke to the licensing department of the council before speaking to you and he told me that the council stated that your staff were not complying with the legislation and he therefore acted on the information. It was also thought that Peddlers had to have some sort of a trolley or cart to transport items that they are selling, this I accept to be wrong, it just means that you become a hawker with trolley or similar.

    I am satisfied that if the officer was informed correctly he would have been better informed to advise you. I am also satisfied that the officer gave you the information in good faith and had no intention of moving your staff on incorrectly.

    I agree that you do not require a Street Traders Licence as there is no local bye-law against Peddlers in this council area, this was never in dispute. What was in dispute was whether your staff were acting as Peddlers.

    Having done my own research I have advised the officer accordingly so he is able to act correctly in the future.

    I am sorry that your staff did not have the best of days in Windsor and I hope your staff have a more favourable experience in Windsor on your next visit.
